This sure is not the story we have been hearing.

(Before the alleged victim drove the plaintiff home, she texted her roommate in the next room, saying, “I think I might have just gotten raped. ... He kept pushing and pushing and I said no but he wouldn’t listen. ... I just want to cry.”)

But if she realy didn't want to have sex with him why didn't she scream? get her room mates attention? If there was a spider or a mouse in her room then everyone on the block would of known. I hope we are close to answer weather we are going to have him play or not. I just want to move on.

First of all.... It looks like Florio is getting tired of taking all the heat, so they found a rat to write this story. Second.. The incident described in the article doesnt sound like the situation that our current QB got himself into.. Nowhere in the article did they say this happend during the foresters ball or that alcohol and drugs played a roll in this. Im confused :?
 
There is far more to this story than what was in the article, as usual. Pay special attention to the portion where the judge comments on the proceeding. Paoli was the one who requested a dismissal. The legal portion of this is far from over kids.
 
I'm still not sure how this changes anything... it's all still a "he said-she said" situation. All I hope is for the correct outcome, & that it isn't true.

But that goes to the question of whether or not "she didn't want him to do it". If someone is doing something to you and you don't want that person doing that action to you, and you have friends in the vicinity, it's a fair question to ask why you didn't ask for help from your friends.

Exactly! Not to mention the fact that the defendant was not allowed to submit other exculpatory evidence that they have. I ever there was a Kangaroo Court, this is just that. How foolish will UM look if it expels him, and he is never even charged in a court of law. The resulting lawsuit will make the settlements paid to O'Day, Pflugrad, and Foley look like chump change.

Couture came into the hearing WITH the plaintiff despite the fact he was supposed to be the neutral chair of the hearing. Typical academic moron, no clue about how real life hearings are supposed to be conducted.
 
The key part of the ruling is in the paragraph:

“From a normative perspective, the process applied to Plaintiff Doe and the behavior of university officials in investigating and prosecuting this matter offends the court’s sense of fundamental fairness and appears to fall short of the minimal moral obligation of any tribunal to respect the rights and dignity of the accused,” wrote Christensen

Engstrom and the members of the university court should all be dismissed.

That is more than a fair question. Another question is why didn't she go to the hospital and/or police that night if she was indeed raped? Why did she wait until months after, and after allegations of sexaul assaults by other football players surfaced. But of course I'm a sexist bigot for questioning anything the accuser says.

nah...those are definitely fair questions. however, there are certainly scenarios in which victims don't make any noise when they are being attacked. if a guy has the balls to rape a chick with people around, who's to say what else he'd do? what if he told her not to make a sound or he'd hurt her? what if he said if she tells anyone he'd kill her? i'm not speaking of this case specifically as i have made it a point to not chime in. too many people are so blinded by a football rivalry that if a fan of another team dares to chime in they immediately disregard it as trash talk. but in GENERAL terms.....it's very common for rape victims to not only not scream for help...but also not report the rape for a long time. and many times...not report it at all.... :(
