Couture v. Foley - Missoulian Coverage

Contrast how the Missoulian has treated Dean Couture and Jim Foley.

Couture tells the accused, in writing, that any discussion of the alleged misconduct with others (I assume this would include the Missoulian) “would result in your immediate dismissal” from the University. The Missoulian doesn’t even quote Couture, let alone accuse him of threatening to punish the student.

Foley asks in an email to Couture: “Is it not a violation of the student code of conduct for the woman to be publicly talking about the process and providing details about the conclusion?” The Missoulian front page headline for their article says: “UM vice president sought to punish alleged rape victim, email reveals”. Huh, where did Foley “seek to punish” the victim? He asked a question. The article also said that Foley was “upset that an alleged rape victim spoke publicly about UM’s handling of her case”. Huh, how did the Missoulian conclude he was “upset”? He merely asked a question.

Is there any basis for this disparate coverage/treatment?

Bias on the part of the Missoulian? Different and unfair treatment for the accused and the accuser? Gender bias? An agenda? Hypocritical?
 
I believe that Foley's behaviors were inappropriate and I now feel the same way about Couture. As for the Missoulian, I am not going down that road. Too well traveled for my tastes.

I emailed Sherry Devlin about the claims against Coture and Aronofsky. She wrote me back:

I hope they actually do, although I wonder how the headline will look, especially compared to the "punishing victims" headline against Foley.

Sitting on the sideline watching this play out, I for one, am thankful of the work Tokyo, PR & BW have done in putting out the non-sensationalized details.....it's quite a breath of fresh air compared to the garbage in the lee enterprises pubs....

Written by different reporters. The headlines are written by the editors. Based on floria's Twitter account she is on vacation so Moy wrote the latest, less biased, article.

Proceedings under the Student Conduct Code are confidential. It was completely inappropriate that Foley would question, in an e-mail discussing the situation with other university officials, whether the victim herself violated code, and he should be flogged. Now if Foley or any other UM official should question whether JJ, through Paoli getting the court documents released, violated the confidentiality of the code, that's ok. It fits the theory of the lynching.

It's perfectly appropriate for Foley, or any UM official, to ask, internally, whether it's okay for a student involved in a university proceeding to talk to the press. It's a blatant violation of the code provide information about the confidential proceeding to the press or anyone. You are the one who should be flogged.

It's perfectly appropriate for Foley, or any UM official, to ask, internally, whether it's okay for a student involved in a university proceeding to talk to the press. It's a blatant violation of the code provide information about the confidential proceeding to the press or anyone. You are the one who should be flogged.

The problem with the internet is one can't always recognize sarcasm. Regardless, I am kind of surprised that you took my post as a serious statement rather than one that in fact actually completely agrees with the point you were making.

Your sarcasm has reached such a sophisticated & advanced level, that most people have no idea when you're serious or joking. :o :) :lol:
 
The Conduct Code says what it says: neither side can publicize the proceedings. Foley simply asked if she had and if so, is that also a violation of the conduct code? It is.

The responses in the Missoulian were to the effect there should be two conduct codes, one for male athletes, and another for all other members of the student body.

That was really what Foley's question was.
