BUT, Nurse Scholl is a very compelling witness from the standpoint of volunteering to become involved after seeing this on TV(or "hearing" about it) and realizing that the procedure was flawed. Expert witnesses who have 1) always previously testified for the prosecution, who 2) volunteer because they perceive an injustice is being done are very believable to a Jury, compared to the run-of-the-mill expert witness.

These kind of witnesses don't come along very often. This was a real defense "coup" from an evidentiary standpoint.

Was this the surprise witness mentioned last week? Only that it was the defense's witness?

I doubt it; expert witnesses who are not disclosed per the discovery order or the omnibus scheduling order can't be added later except by motion and stipulation ... and "the other side" is not likely to stipulate.

I have done my best to remain neutral and open minded, but Its getting pretty hard. This alleged victim and her witnesses are leaving a ton to be desired. They have been picked apart to the point where there credibility has been incredibly weakened. Still a long ways to go though I suppose.


At this point I couldn't care less if we see him on the field again. I just want him to be able to leave a free and normal life after having to go through what is looking more and more like a farce. If football is part of that life than great, but if not I wouldn't blame him.

Yes, basically the prosecution’s whole case is derived from Doe’s psychological behavior after the alleged rape took place. There is no physical proof that a rape occurred. The testimony actually leans towards consensual sex in my opinion. Jane Doe's testimony was enough put doubt in my mind that she may not have let JJ know that she did not consent.

This is a he said/she said textbook case. No sane man or woman in this world could put a young, intelligent promising man away with what the Prosecution just presented.

The defense will not last long. This will be done by Friday.

I have been telling the world all along that JJ will never be convicted. This is the weakest rape case in history, and would have never gone to trial in any other jurisdiction except for the huge publicity surrounding it.

What this girl does not yet understand is that her life will never be the same again. She will have to leave the state, because this trial and her ridiculous accusations to cry rape will follow her for life.

The reason I ask because I don't think the details of the SARC nurse's protocol came out until after she testified. Scholl states she learned of the evidence while watching the evening news? Please correct me if I'm wrong?

I was actually checking with intelligent people who were following twitter when the trial first started, so this wasn't addressed to your stupid, inbred ass. Carry on loser.

That's a good point; when she said it, I thought she would have meant some time back; but, if she heard it during the trial, which makes sense, then there would have been a motion to add a witness -- "newly discovered evidence" -- and the Judge would have granted the motion for her to have appeared, which explains the absence of howling and screaming by the Prosecution -- that had already occurred in chambers.

Luckily, we don't have to wait for the trial to be over before Donkey Punch is exposed as a dumbass, as that has already been proven beyond a reasonable doubt.

That should happen, but in this twisted town she will be glorified and probably given an award by the Missoulian.

Coming from two class acts who wanted the alleged victim exposed on Egriz, I'm not surprised by your vitriol towards me. The internet tough guy act is easy to pull off.

By the way, I have NEVER said that JJ would be convicted or was automatically guilty. I said he would likely be acquitted. Pay attention.
 
Katherine Scholl's testimony reinforces what Dr. Ted Harriton said about Claire Francoeur's exam of alleged victim being "Beneath the standard of care."

The prosecution tried to dismiss Dr. Harriton as a hired gun for defense lawyers, which he is. They did forget to mention in the rape cases he agrees with the doctor or nurse's exam of an alleged victim, the defense attorneys that hired him usually plead out the case--they know their client is probably guilty. Paoli pointed this out to the jury.

Katherine Scholl, who contacted the Paoli and Pabst after she heard something on the local news about the trial that struck her as a forensic nurse about Francoeur's examination of the alleged victim as just plain wrong, is just what Paoli, JJ, and Pabst needed: a forensic nurse that is a Certified Medical Investigator, Level III, a Fellow with The American College of Forensic Examiners that conducted 600 rape exams and testified in 150 rape cases and always for the prosecution, until now !!!

This retired nurse living in The Bitterroot also appropriately attacked Francoeur's ethics and judgement for texting the alleged victim with the rah-rah "You go girl!" messsages and recommending attorneys to her.

The prosecution is trying to minimize Scholl's damage, pointing out she last practiced in Florida in 2005, her license expired in 2008, she hasn't taught a sexual-assault examination course since 2009, waah, waah, waah etc.

I think she reinforces the testimony of Dr. Harriton, she is a very well trained and experienced rape examiner, and she has always testified for the prosecution until now, plus she contacted the defense to tell them Francoeur's exam and ethics were seriously flawed--Paoli and Pabst didn't call her, she called them !

I think this adds up to one big problem for the prosecution: the credibility of their star witness other than alleged victim, Claire Francoeur, whose credibility has taken another huge, perhaps fatal hit.
